Terms and Conditions
Access to and use of the website www.santacarolinatours.cl is governed by the General Terms and Conditions (hereinafter, interchangeably, “Terms and Conditions”) described below, as well as by the laws in force in the Republic of Chile. Consequently, all visits and all contracts and transactions carried out on this site, as well as their legal effects, will be governed by these rules and subject to that legislation. These General Terms and Conditions will apply to each and every consumer who has contracted and contracts our services.
By reading and understanding these terms and conditions, you will be able to make better use of the website and properly exercise your consumer rights. For this reason, we suggest that you read these terms and conditions carefully, print them, and keep a printed copy.
- Turistik S.A.
Turistik S.A. (hereinafter “Turistik”), RUT 76.708.000-K, is a closely held corporation, a limited-liability commercial company, incorporated and domiciled at Encomenderos 260, Office 11, Las Condes, RM, Chile.
We are the official Tour Operator for the Viña Santa Carolina tourism experience. We offer leisure and recreation experiences online, acting as an intermediary in the contracting of our own leisure services and those of other tourism and entertainment service providers. It is hereby stated that the site user understands and accepts, by accepting these terms and conditions, that Turistik offers, directly and indirectly, services or products operated by Turistik or contracted through its intermediation, with the tourism and/or entertainment service provider companies and/or their partner network being the ones that provide the product and/or deliver the contracted service in the event that the purchase is intermediated by Turistik S.A.
The products and services offered are shown at the time they exist, meaning with online availability, since this refers to displaying an inventory updated at the time availability and prices are shown. However, Turistik does not guarantee that, at the time of booking and/or purchase, that price will still be valid.
Tourism services for the Viña Santa Carolina experience are provided through the website www.santacarolinatours.cl, so the purchase and booking processes, validation, and confirmation are carried out online. For this reason, it is essential that the user has a valid, active email account where they can receive the information sent by Turistik S.A. Turistik will not be responsible for possible errors in the user’s email address or if their account does not properly receive emails sent by Turistik.
- Knowledge and acceptance of the Terms and Conditions
Acceptance of these Terms and Conditions will be a necessary requirement for the purchase and/or booking of products and services offered on this site. They will be deemed known and accepted by the user when the “accept” option indicated in the box created for this purpose is selected, and this selection will be a prerequisite on the site for booking and/or purchasing any product or service. Turistik will not process bookings and/or purchases unless the user previously declares that they know and accept the Terms and Conditions of the website and of the specific product or service they are contracting, expressly stating their agreement with said Terms and Conditions.
- Viña Santa Carolina Experience
It consists of a guided visit to historic cellars and a wine tasting for those over 18. Minors must attend accompanied and may not consume alcohol. As it is a heritage site, respectful behavior is required for its preservation, and the visitor is responsible for any damage caused. Turistik and Viña Santa Carolina are not responsible for lost personal belongings. Purchasing the ticket implies full acceptance of the tour’s terms and conditions.
- D. User registration and password
In order to contract the different services that Turistik offers through this site, such as tourism services, packages, tickets, ticket sales, among others, as well as to receive newsletters with information about offers, the user must register as such using a unique username and an associated password that will allow personalized, confidential, and secure access. The user will have the option to change the password, for which they must follow the procedure established on the site.
Turistik will ensure the confidentiality of the user’s password, which will allow them to make purchases, request services, and obtain information. This password is for personal use, and providing it to third parties without Turistik’s prior authorization will not entail liability for Turistik.
At the time of registration, the user must declare that all information provided is true, complete, and accurate, and that it complies with Law No. 19,628 on the Protection of Private Life or Protection of Personal Data.
The person who registers expressly authorizes Turistik to include in an automated file the personal data contained in the form fields, as they are necessary for the proper provision of its services, such as: booking tourism services, tickets, and developing services related to the marketing of said services, as well as to:
(a) Verify credit cards and other types of payment cards.
(b) Carry out statistical analyses.
(c) Comply with accounting, invoicing, and audit requirements.
Turistik is responsible for keeping the data provided by the user confidential for the purpose of exercising the rights of access, rectification, cancellation, and objection provided for by law.
Likewise, upon registering, the user expressly authorizes the communication of said data to third parties consisting exclusively of Turistik’s associated service providers, only when such communication is necessary for the proper provision of the services contracted, always respecting the legislation in force.
The user gives their express consent to receive electronic communications with advertising and commercial news from Turistik and from the products or services it markets or promotes, in accordance with our Privacy Policy.
The User has the right to request from Turistik access to, rectification of, and, where applicable, deletion of the personal data concerning them. To do so, they must send a request to the email address [email protected], clearly stating their full name, RUT, DNI and/or specific details used to identify them as a user.
- E. Rights of the user of this site
The user will enjoy the rights recognized by the consumer protection legislation in force in Chile, under the terms established in Law No. 19,496, and as indicated in these Terms and Conditions.
- F. Procedure for using this website
In contracts offered through this site, consent will only be deemed formed when the user has previously had clear, understandable, and unequivocal access to the general conditions thereof and the possibility to store or print them. To comply with the above, Turistik will inform the user on the website, unequivocally and easily accessible, of the steps that must be followed to contract each service and will inform them of the general contractual terms and conditions of each one in particular.
It is expressly stated that merely visiting the website does not impose any obligation on the user, unless they have unequivocally and expressly accepted the conditions offered by Turistik.
Once the contract has been completed, Turistik will send the user written confirmation of its specific terms. This may be sent electronically or by any means of communication that guarantees the user’s due and timely awareness, which will be indicated in advance. Said confirmation will contain a complete, clear, and legible copy of the conditions of the contracted service.
- G. Payment methods that may be used on this site
The products and services offered, unless a different method is indicated for particular cases, may only be paid for with bank cards both in Chile and abroad, provided that the issuing entity maintains a valid contract for such purposes with Turistik or any of its related companies.
By entering their account or card details and accepting the transaction, the user authorizes the charge for the price and/or fee, and payment of Turistik’s service charge.
Use of the cards specified above will be subject to what is established in these Terms and Conditions and, in relation to their issuer, to what is agreed in the respective Account Opening Agreements and Terms of Use of the issuing entity. In the event of a contradiction, what is stated in these latter two instruments (Account Opening Agreements and Terms of Use) will prevail.
If the user makes an installment purchase using a credit card, the interest, taxes, commissions, or other charges that installment purchases by credit card may generate will depend on the conditions the user has agreed with the card’s issuing entity. We recommend that you inform yourself of your credit card’s terms of use and interest conditions before using the installment purchase option.
Cards issued abroad do not allow installment payments unless explicitly stated otherwise.
In the case of bank cards accepted on this site, aspects related to them, such as the issue date, expiration, credit limit, blocks, etc., will be governed by the respective Account Opening Agreement and Terms of Use.
In the event of any error or inconsistency experienced by the user in transactions carried out with the aforementioned payment methods, due to causes attributable to the issuing companies, Turistik will assume no liability, without prejudice to collaborating with the user, within the scope of its competence, in the procedures and claims they submit to the responsible entities.
- H. Offer, booking platform, facilitation of transactions, steps, and completion of the transaction
Turistik offers users who access its website a platform to search for promotions that follow one another as long as there is availability from the different providers, so that the user can purchase products and services under more affordable conditions than those usually offered through traditional sales channels.
In addition, and in order not to create false expectations for the user, it is informed that the published rates are those available online at the time of the search, and they cease to be valid once purchased by a user, so they vary constantly. In addition, they are subject to availability of slots from the different providers and are for a limited time.
Once the transaction has been carried out by the user completing each and every purchase step, Turistik will send an email to the user confirming their purchase or booking request, and the process of validating and finalizing the user’s request will begin.
To complete the above, Turistik must first:
i) Validate and accept the payment method offered by the user; and ii) Confirm that the data registered by the user on the site matches the data provided when accepting the offer. If any of these steps fails, the booking and/or purchase request will not be completed.
If the validation and completion process is successful, Turistik will send the user, by email, a receipt for the booking services as well as the vouchers or tickets from the different service providers.
Additionally, and in order to inform the user about the validation of the transaction, Turistik will send a confirmation that the purchase and/or booking process has been completed to the email address provided by the user (or by any means of communication that guarantees the consumer’s due and timely awareness, in case there are problems that prevent sending the email).
Such confirmation must contain a complete, clear, and legible copy of the contract corresponding to the product purchased and/or the service contracted.
- I. Validity of the offers contained on this site
The prices of the products and services available on the Turistik site will only be valid and applicable for a limited and brief period while they appear published on it, and will not necessarily apply to other sales channels that Turistik may use, such as catalogs or others.
- J. Right of withdrawal
Turistik informs that, by virtue of the provisions of Article 3 bis letter b) of Law No. 19,496 on Consumer Protection, the right of withdrawal does NOT apply to purchases made through us, so the user may not unilaterally terminate the contracting of the product and/or service entered into with Turistik.
Turistik reserves the right to cancel the service at any time in the event of force majeure or unforeseen events. If Turistik cancels the service before the activity begins, all fees paid by the customer will be refunded.
- K. Property rights
All content, brands, logos, drawings, etc. that appear are protected by intellectual and industrial property rights, which are expressly reserved for Viña Santa Carolina and Turistik, their related companies, or, as applicable, the individuals or companies listed as authors or rights holders. Violation of the above rights will be prosecuted in accordance with the legislation in force.
Therefore, the reproduction, exploitation, alteration, distribution, or public communication by any title or means of all content on the website www.santacarolinatours.cl is prohibited for uses other than legitimate information or contracting by users of the services offered. In any case, prior written consent from Viña Santa Carolina and Turistik will be required.
- L. Complaints procedure
To submit any complaint regarding acts or contracts executed or entered into through www.santacarolinatours.cl, Turistik will follow the procedure below:
(a) The user must send their submission or complaint to the email address [email protected]. We recommend that, along with your email, you send all supporting information for your complaint and include a description of what happened, clearly and precisely stating the solution you expect, in order to provide a response as quickly as possible.
(b) Turistik will review the complaint, and the first response will be sent to the same email address used for the complaint within 48 hours of receiving the information. If an additional period is required, the user will be informed.
